ClearStack B.V. and the Digital Services Act

ClearStack B.V. provides hosting and cloud infrastructure services, including KVM VPS and web hosting services operated under the quicksrv brand.

Certain ClearStack services constitute hosting services under Regulation (EU) 2022/2065, the Digital Services Act (DSA).

Notice and action

Anyone may submit a notice concerning specific information hosted through a ClearStack service that they consider to be illegal content.

A notice should identify the relevant content as precisely as possible and explain the basis on which it is considered illegal.

We assess notices in a timely, diligent, objective and non-arbitrary manner, taking into account the information provided and the applicable legal and contractual framework.

Decisions concerning reported content

Depending on the circumstances, ClearStack may take measures including requesting remediation, restricting access to content or services, suspending a service, terminating a service, or taking other measures permitted or required by law.

Where the DSA requires a statement of reasons for a restriction imposed on the basis of illegal content or a violation of our terms, we provide the affected recipient with the applicable reasons.

Terms and content restrictions

The rules governing customer use of ClearStack services are set out in our Terms of Service and Acceptable Use Policy.

The Acceptable Use Policy describes prohibited content and activities, including network abuse, malware, phishing, unauthorised access, spam and other activities that may harm our infrastructure or third parties.
